1. Independent Contractor Relationship
You are an independent contractor, not an employee, partner, joint venturer, franchisee, or agent of Tavfon. This Agreement does not create an employer-employee, master-servant, principal-agent, or joint-venture relationship.
You agree and acknowledge that:
- Tavfon does not direct or control the manner or means by which you perform services.
- You decide whether to accept any particular booking.
- You set your own rates, hours, service area, equipment, and methods.
- You are not entitled to employee benefits of any kind (health insurance, paid time off, unemployment, worker’s compensation, etc.).
- You are responsible for reporting and paying all applicable taxes on your earnings.
- You may perform similar work for other parties, including other platforms.
2. Taxes, Licenses and Insurance
- You are solely responsible for all federal, state and local taxes on your earnings, including self-employment tax.
- You will provide Tavfon with valid tax information (W-9 or equivalent) prior to receiving payouts.
- You must hold and maintain any licenses, permits, certifications, and registrations required by your jurisdiction for the services you provide.
- You must carry and maintain general liability insurance appropriate for your trade, and where applicable, worker’s compensation for any employees or sub-contractors you engage.
3. No Guaranteed Income
Tavfon makes no guarantee of any minimum number of bookings, invitations, hours, or earnings. Demand depends on market conditions, your service area, your responsiveness, and customer choice.
4. Verification and Documents
Before you can accept your first booking, you must complete Tavfon’s verification process, which includes:
- Government-issued photo ID and a live selfie match.
- Trade license where required.
- Proof of general liability insurance, verified with the carrier.
- Criminal background check via an accredited screening provider.
- Tax information for payout reporting.
You agree to keep documents current and to update Tavfon promptly if any document expires, is revoked or is invalidated.
5. Code of Conduct
- Treat all customers professionally and respectfully at all times.
- Show up on time, prepared, and in appropriate professional attire.
- Confirm the safety code with the customer before starting any work.
- Communicate only through the in-app chat. Do not solicit off-platform transactions.
- Document the job site with photos. Leave it as clean as you found it.
- Do not bring unauthorized persons, weapons, alcohol or drugs to a job site.
- Comply with our Safety Policy, Community Guidelines and applicable law.
6. Pricing, Fees and Payouts
- You set your own price per booking. Tavfon may suggest market ranges but never sets your price.
- Tavfon retains a per-booking platform fee, disclosed transparently before each booking.
- Payouts are processed via Stripe and released after the safety code is exchanged and the customer confirms completion.
- You are responsible for keeping your Stripe payout details current.
- Any tips received are yours to keep in full. Tavfon does not take a cut of tips.
7. Cancellations and Disputes
Cancellations and disputes are handled under our Refund & Cancellation Policy. Habitual no-shows, late cancellations or unresolved disputes may lead to account review.
8. Account Suspension and Termination
Tavfon may suspend, deactivate or terminate your provider account at any time if:
- You violate this Agreement, the Terms of Service, the Safety Policy or Community Guidelines.
- You fail to maintain a required document (license, insurance, etc.).
- Your quality, dispute or cancellation metrics fall below platform thresholds.
- We receive credible reports of unsafe, fraudulent or harassing behavior.
- We are legally required to suspend your account.
You may close your provider account at any time, subject to completing any in-flight bookings and finalizing payouts.
9. Intellectual Property
You retain ownership of photographs and content you upload, but grant Tavfon a worldwide, non-exclusive license to host, display and use that content to operate the platform and market your services. Tavfon’s name, logo, and platform technology remain Tavfon’s intellectual property.
10. Confidentiality
Customer contact information, addresses, and job details are shared with you solely to complete bookings. You agree not to use this information for any purpose outside the booking, including marketing or off-platform solicitation.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tavfon, its affiliates, and their respective officers, directors, employees and agents from and against any claims arising from your services, your negligence, your breach of this Agreement, your tax responsibilities, or your violation of any law.
12. Governing Terms
This Agreement is subject to and incorporates by reference the Terms of Service, including the arbitration and class-action-waiver provisions, and is governed by the laws of the State of Maryland.
